ที่ดินราชพัสดุเป็นที่ดินหลวง ไม่สามารถซื้อขายได้ แต่สามารถเช่าระยะยาวได้ (lease) การครอบครองที่ดินราชพัสดุโดยไม่ได้รับอนุญาตเป็นการบุกรุก มีความผิดตามกฎหมายอาญา
